Arbitration Funding

Our Arbitration Funding will pay the cost of pursuing legal disputes in return for a share of the damages recovered in arbitration proceedings. We will cover Institutional Arbitration, Ad Hoc Arbitration, Investor-State Arbitration and Alternative Dispute Resolution.

Our funding is designed to reduce the cost and cash-flow disruption of dispute resolution. We offer clients with good cases and limited financial resources, the security that we arrange for Litigation Protection to offer to insure the legal cost risk of the litigation in the event that the case is unsuccessful. We will also arrange for the provision of interim/early case funding for the client's own legal costs in order to progress the case.

We can provide funding for all costs associated with arbitration:

  • Arbitrators' costs (a maximum cap will be agreed)
  • Counsel's Fees
  • Fees of Expert Witness / Experts appointed by a tribunal or by parties
  • ATE insurance premium for obtaining a protection from adverse costs
  • Security for Costs
  • Administrative Expenses
  • Disbursements
  • Mediation or adjudication costs as the first part of a multi-tiered dispute resolution mechanism
  • Early stage funding in order to progress the case

    • American Arbitration Association/International Centre for Dispute Resolution (AAA/ICDR)
    • Stockholm Chamber of Commerce (SCC)
  • Ad hoc arbitration under UNCITRAL Arbitration rules
  • Investor-State Arbitration - ICSID, NAFTA

What we look for in a case:

Minimum costs funded £150,000
Damages claimed must be in excess of £2 million

We will consider funding arbitration cases in any jurisdiction where funding is permitted.
